Qualification
of a patent attorney:
With the
increase of applications for registration of patent, the question
of qualification requirements for patent attorneys in Turkey has
become important. Only patent attorneys are statutorily allowed
to represent foreign applications with regard to patents before
the Turkish Patent Institute (TPI).
Since legal
practice does not require candidates in the field of science and
technology or subsequently to have gained a professional experience
under a professional representative dealing with patents matters,
a person with a bachelor degree from a university, passing out the
TPA examination and have a good moral character and good repute
qualifies as a Turkish Patent Attorney (TPA). The exam is held after
every two years which includes IP-related national laws and regulations,
international agreements and an article on this subject. Scoring
70 out of 100 qualifies a person to become TPA. However patent attorneys
cannot conduct patent litigation in the courts. In order to harmonize
the Turkish patent attorney system with modern provisions, a draft
law has been completed for establishing a Turkish association
of patent attorneys to improve the ethical and professional standards.
